Why you couldn't just

unsigned int bufsiz;

/* ... */

bufsiz = sizeof(priv->data_buffer);
if (in_size < bufsiz)
	bufsiz = in_size;

out_size = tpm_transmit(priv->chip, space, priv->data_buffer, bufsiz, 0);
